These Terms of Service ("Terms") govern your use of the Movio Hosting Streaming Service (the "Service"). By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
We may update these Terms from time to time. If changes are material, we will notify you at least thirty (30) days before they take effect. Your continued use of the Service after such updates means that you accept the revised Terms.
2. Account Registration
To access our Service, you must create an account. You must provide accurate and complete information when creating an account. You are solely responsible for the activity that occurs on your account and for maintaining the confidentiality of your account password.
3. Payments
You are required to make payments for the Service as per the payment plan chosen during the registration process. Movio Hosting reserves the right to change the payment terms and fees upon thirty (30) days prior written notice to you.
4. Content and Hosting
Movio Hosting provides a cloud-based application service that allows you to stream content. The content that you stream through our Service is not hosted or provided by Movio Hosting. The content is locally hosted by you, the user/subscriber, and you are solely responsible for ensuring that you have the necessary rights and permissions to stream such content. Movio Hosting does not claim any ownership rights in the content that you stream through the Service. All ownership and intellectual property rights in the streamed content belong to the respective content owner. Movio Hosting does not assume any liability for the content that you choose to stream via our Service.
5. User Obligations
You agree not to download any content from the Service. You further agree not to defame, abuse, harass, or otherwise violate the legal rights of Movio Hosting or others. Any violation of these obligations may result in immediate suspension or termination of your account. You are also responsible for obtaining all necessary rights and permissions to stream content using the Service.
6. Disclaimers and Limitation of Liability
Movio Hosting is not responsible for the content that you choose to watch on the Service. You expressly agree that your use of the Service is at your sole risk. Movio Hosting will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of the Service.
7. Termination
Movio Hosting reserves the right to suspend or terminate your account if you breach these Terms, engage in harmful activity, or attempt to misuse the Service. We may also restrict access when necessary to protect the Service and its users. In the event of termination, you will still be bound by your obligations under these Terms, including the warranties and indemnities.
8. Refund and Cancellation Policy
Movio Hosting is committed to providing a straightforward and fair cancellation process. If you wish to cancel your account within the first fourteen (14) days of signing up for the Service, you are eligible for a full refund of any payments made within that period. To ensure your cancellation is processed correctly and to initiate the refund process, you must cancel your product or service through our official systems, such as the Dashboard or Client Area.
Important Cancellation Procedure: Cancellations must be processed via our official channels (Dashboard or Client Area) to be recognized. Cancelling your subscription or service by directly stopping payments through payment gateways (e.g., PayPal) without notifying us through these official channels is considered an abuse of the cancellation process. Such actions prevent our system from automatically detecting and processing your cancellation. Consequently, products or services cancelled in this manner will be deemed ineligible for a refund, regardless of whether this occurs within the initial 14-day period.
After the first fourteen (14) days of signing up for the Service, if you choose to cancel your account, you will not be eligible for a refund, either partial or in full. Your access to the Service will continue until the end of your current billing cycle, at which point it will cease.
If you accidentally overpay or make an incorrect payment, Movio Hosting may provide either a refund or a credit to your account, at our discretion. Credits issued to accounts are valid for a maximum of twelve (12) months from the date of issuance. Any unused credits after this period will expire and cannot be refunded or reissued. Additionally, all credits will immediately expire and become void if your account is terminated by Movio Hosting for a violation of these Terms, or if you voluntarily cancel or close your Service.
Additionally, Movio Hosting reserves the right to disable or cancel a user's account without a refund if it suspects that the user is engaging in suspicious behavior, harming another user or the service, or attempting to manipulate, hack, or illegally download content. This measure is to ensure the safety and integrity of the Service for all users.
Please note, if your account is terminated by Movio Hosting for a violation of these Terms or due to the aforementioned reasons, you are not eligible for a refund.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.
